Terms and Conditions
If this Application is submitted and approved via email by Fight 4 Cure Inc, it shall become a contract and shall be subject to the following terms:
Contributions to Fight 4 Cure Inc which are received by the Applicant (“Individual Contributions’) and made by the Applicant will be sent to Fight 4 Cure Inc no later than thirty (30) days after the Fundraiser/Event. The Individual Contributions will be paid in United States dollars and sent online at donate.
In performing obligations under this Application, the Applicant will comply with all applicable federal, state, and local laws and regulations including but not limited to all laws and regulations that regulate statements to the public concerning the amount of the Contribution. Each reference to the Applicant’s Contribution will specifically and accurately describe the Applicant’s Contribution (e.g. income less expenses should not exceed 30% of revenue and should be submitted within 30 days of the event).
Applicant will state that no portion of the purchase price of any goods/services sold at the Fundraiser/Event is tax deductible unless donation is made directly to Fight 4 Cure Inc using the outlined methods of donation via the website. If such is the case, the individual donor will receive an acknowledgement letter from Fight 4 Cure Inc for use as a tax-deductible receipt.
The Applicant will not represent that Fight 4 Cure Inc is a producer, co-producer, sponsor, or presenter of the Fundraiser/Event.
This Application does not create any partnership, agency, or joint venture relationship between the Applicant and Fight 4 Cure Inc, and neither Fight 4 Cure Inc nor the Applicant will make any representations to the contrary.
Upon approval of the Fundraiser/Event, Applicant may state in promotional materials that proceeds from the Fundraiser/Event will be donated to Fight 4 Cure Inc. In connection with such statements, and for no other purpose, Fight 4 Cure Inc grants to the Applicant a non-exclusive license to use the Fight 4 Cure Inc name and logo upon and in connection with the Fundraiser/Event. The Applicant shall have no right to grant any sublicenses under this Agreement. The Applicant will provide Fight 4 Cure Inc with sample copies for approval of all publicity or promotional materials that include Fight 4 Cure Inc’s name and logo prior to publication or distribution.
If Fight 4 Cure Inc determines, in its sole discretion, that the Fundraiser/Event or related activities could injure the goodwill or reputation of Fight 4 Cure Inc, Fight 4 Cure Inc may terminate this Agreement immediately. Upon the expiration or termination of Fundraiser/Event, the Applicant shall discontinue using the Fight 4 Cure Inc name and logo and all materials that reference the Fundraiser/Event.
Applicant is not permitted to dispense or serve alcoholic beverages at approved Fundraiser/Events regardless of the legal drinking age of individuals to be in attendance.
This Application requires that the Applicant carry Fundraiser/Event liability insurance coverage from a company of their choosing. Fight 4 Cure Inc will also allow the Applicant to waive the liability insurance requirement and still be permitted to host the Fundraiser/Event. The Applicant understands by waiving the liability insurance requirement means that the Applicant will bear the costs of their own losses such as fire, theft, injury, etc. Fight 4 Cure Inc strongly recommends and prefers that the Applicant obtain Fundraiser/Event liability insurance coverage.
Applicant shall release, defend, indemnify, and hold Fight 4 Cure Inc, its directors, officers, agents, attorneys, representatives, volunteers, successors and assigns, harmless from all claims, liabilities, judgments, penalties, losses, costs, damages and expenses (including reasonable attorneys’ fees, whether or not litigation is instituted) paid or incurred by Fight 4 Cure Inc by reason of any activities relating to this Fundraiser/Event.
